THE DRIFT Accommodation Terms and Conditions
1. PURPOSE
Under this contract, THE DRIFT and any affiliated entities within the corporate structure (hereafter referred to as “THE DRIFT”) will provide lodging to the GUEST in the unit and its accessories, in exchange for a fee, for the number of days indicated in the Reservation and the corresponding Hotel Registration Card.
1.1 The unit provided will be specified in the Hotel Registration Card. THE DRIFT reserves the right to change the assigned unit, subject to the GUEST’s acceptance, provided the new unit is of equal or superior quality or in cases of unforeseen circumstances or force majeure.
1.2 Check-in time begins at 3:00 PM on the day of arrival, and check-out time is by 11:00 AM on the day of departure. The period between these times constitutes a hotel day. Early check-in or late check-out is subject to availability, and the GUEST will be required to pay the corresponding fee.
1.3 Lodging is provided regardless of the actual amount of time the GUEST stays in the unit. Partial use incurs the full rate.
1.4 The services covered under this contract, as well as any additional services offered by THE DRIFT, are subject to availability, schedules, and the physical stock of supplies, facilities, or spaces. The assigned unit and the nightly rate will be those indicated in the Hotel Registration Card and linked to the reservation.
2. PRICE
2.1 The price of this contract corresponds to the nightly rate the GUEST agrees to pay, as indicated in the Hotel Registration Card and corresponding to the reservation. This will be detailed in the invoice unless the reservation was made and paid through a travel agency, in which case the agreed rate with the agency will apply.
2.2 The GUEST must also pay for any charges incurred during the stay, including food, beverages, and additional services charged to their account.
2.3 The GUEST acknowledges having been informed of the nightly room rates and associated fees.
2.4 Non-payment of agreed amounts will result in late payment interest at the maximum legal rate.
3. CUSTODY OF MONEY AND VALUABLES
Unless stored in the in-unit safe or explicitly inventoried and handed over to authorized hotel personnel, THE DRIFT is not responsible for money or valuables left in the units, as their custody remains the sole responsibility of the GUEST.
4. OBLIGATIONS
4.1 Obligations of THE DRIFT
4.1.1 To provide the services stipulated in this contract.
4.1.2 To address, process, and respond to suggestions, complaints, or claims submitted by the GUEST.
4.1.3 To safeguard money and valuables stored in safes or handed over as per the terms described above.
4.1.4 To fulfill any additional legal obligations.
4.2 Obligations of the GUEST
4.2.1 To identify themselves at check-in with a valid ID (e.g., national ID, passport, or applicable document for foreign nationals). Minors must present valid identification.
4.2.2 To pay for lodging and applicable taxes.
4.2.3 To pay for all charges incurred during the stay.
4.2.4 To behave respectfully and dress appropriately.
4.2.5 To be liable for their actions and those of their companions or guests.
4.2.6 To register all companions or guests at THE DRIFT’s reception and pay for each additional person.
4.2.7 To adhere to the unit’s occupancy limits.
4.2.8 To assume responsibility for any risky or dangerous activities they choose to engage in, exonerating THE DRIFT from liability for any resulting harm or injury.
4.2.9 To use furnishings, equipment, and facilities responsibly, and to cover costs for any damages or losses caused by the GUEST or their companions.
4.2.10 To allow THE DRIFT’s staff to inspect the unit when deemed necessary.
4.2.11 To permit staff access for routine cleaning or maintenance.
5. TERMINATION OF THE CONTRACT
The lodging contract will terminate under the following conditions:
5.1 Upon expiration of the agreed term.
5.2 For non-compliance with payment obligations or other terms by the GUEST.
5.3 If the GUEST’s behavior or attire compromises the well-being or health of other guests.
5.4 For smoking in smoke-free areas, with penalties outlined below.
6. EFFECTS OF TERMINATION
6.1 Upon termination, THE DRIFT may reassign the unit freely.
6.2 THE DRIFT may inventory and store the GUEST’s belongings at their risk.
6.3 Unpaid balances may be covered by selling the GUEST’s belongings as per applicable laws.
7. MISCELLANEOUS
7.1 The lodging contract is commercial and evidenced by the signed Hotel Registration Card.
7.2 THE DRIFT condemns and prohibits sexual exploitation and abuse.
7.3 Smoking in units incurs a fee of USD 250 per day plus the cost of two nights’ accommodation.
7.4 THE DRIFT supports flora, fauna, and cultural heritage conservation laws.
7.5 THE DRIFT opposes all forms of discrimination.
PRIVACY NOTICE
By signing this contract, the GUEST authorizes THE DRIFT to collect and process personal data for loyalty activities, service surveys, and promotional communications.
